MS. AUSTIN KIRKBY, 1601 CONCESSION 2 ROAD
RE: REPORT CDS-12-016
AGRICULTURAL ADVISORY COMMITTEE MINUTES - FEBRUARY 1, 2012
Ms. Kirkby stated she was present as directed by the Agricultural SubCommittee to express the importance of having the former Town Principal Planner, Ms. B. Wiens, continue to be involved with the negotiations that are underway to reach consensus with the province and the Region about the Greenbelt policies that will have a major affect on most of the properties in the rural area.
Ms. Kirkby stated the province has a map that includes road drains, farm swales and municipal drains that are man made and not natural watercourses. She stated the Region has prepared a map showing all properties that are impacted by Greenbelt policies.
Ms. Kirkby stated the Agricultural SubCommittee submitted a document to the Town explaining the reasons Ms. Wiens should work on a contract basis to continue to be involved in the negotiation process with the Region and the province as she has been a part of the negotiation process from the start.
In answer to a question, Ms. Kirkby stated she anticipates the negotiation process to take another 3 months.

BUSINESS:
1.a) REPORT CDS-12-022
RE:
228 QUEEN STREET
APPLICATION FOR ZONING BY-LAW AMENDMENT
Discussion took place regarding the zoning and tax classification for 228 Queen Street. Staff will provide information for the Council meeting on how taxes are established.
Moved by Councillor M. Bau-Coote, that the recommendations contained in Community & Development Services Report CDS-12-022 be adopted to include that subject to the input from the public meeting:
1.1 that the draft Zoning By-law amendment, attached as Appendix A to this report, to provide for a residential use in the Site Specific zoning for 228 Queen Street be approved and be forwarded to Town Council for passage; and,

1.2 that the proposed zoning by-law amendment is consistent with the Provincial Policy Statement, Provincial Policy Plans, Regional Policy Plan and the Town Official Plan.

1.b) REPORT CDS-12-016
RE:
AGRICULTURAL ADVISORY
COMMITTEE MINUTES - FEBRUARY 1, 2012
Discussion took place regarding Ms. Barb Wiens, former Principal Planner for the Town, to act as a consultant for the purposes of continuing to be part of the negotiations with the Region and the Province regarding the Town's Comprehensive Zoning By-law.
In answer to a question, the Director of Community & Development Services noted Ms. Wiens will continue to provide her services on a pro-bono basis.
The C.A.O. noted staff have worked with Ms. Wiens current employer to allow her to continue to work on an as needed basis. He stated by receiving the recommendation of the Agricultural SubCommittee this will allow staff to continue having meetings with Ms. Wiens and Ms. Kirkby, of the Agricultural Advisory subcommittee, and through the transition period have the resources to deal with the ongoing negotiations.
Moved by Councillor G. Zalepa, that the recommendation contained in Community & Development Services Report CDS-12-016 be adopted to include:
1.1 that the minutes of the Agricultural Advisory Committee meeting of February 1, 2012 be received.

1.c) REPORT CDS-12-023
RE: SIGN VARIANCE COMMITTEE MINUTES - MARCH 14, 2012
Moved by Councillor T. Flynn, that the recommendations contained in Community & Development Services Report CDS-12-023 be adopted to include:
1.1 that the March 14, 2012 Sign Variance Committee minutes be received;
1.2 that the following recommendations from the March 14, 2012 Sign Variance Committee meeting be adopted.

1.2.1 that the request for a variance to Section 4.04 (2) of Sign By-law No. 4400-10 for 545 Niagara Stone Road to allow for a second temporary sign that is 2 feet x 3 feet and 4 feet above ground be approved on the condition that:
1. the temporary second ground sign only be erected from April to December in 2012 and 2013; and
2. the temporary second ground sign be removed after December 31, 2013.

NEW BUSINESS:
2.a) PUBLIC INFORMATION MEETING - MARCH 19, 2012
PAXTON LANE, SETTLEMENT SUBDIVISION EXTENSION
APPLICATION FOR DRAFT PLAN OF CONDOMINIUM
A
ND ZONING AMENDMENT
Discussion took place regarding the Public Information Meeting for Paxton Lane, Settlement Subdivision Extension, which took place at 6:30 p.m., March 19, 2012. The Public Information Meeting process was explained.
Discussion took place regarding the start time for public information meetings and the possibility of revising to an earlier start time to allow all interested parties the opportunity to speak regarding the issue.
In answer to a question, the Director of Community & Development Services stated staff would be willing to hold a second Public Information Meeting to accommodate those who were not able to speak at the March 19 meeting.
Direction was given to staff to review the public meeting notices to be more clear and concise.
Moved by Lord Mayor D. Eke that staff prepare a second Public Information Meeting notice regarding Paxton Lane, Settlement Subdivision Extension and that this notice invite all residents of the St. Davids Settlement Subdivision and be delivered to each homeowner in the subdivision.

TELECOMMUNICATION TOWERS
Discussion took place regarding information needed to make a proper decision for telecommunication towers. Direction was given to staff to provide more information on Council's role regarding the upcoming Government of Canada, three public information meetings regarding telecommunication towers.

2.c) NEWSPAPER ARTICLE
RE: DECEASED ANIMALS DISPOSED OF
ON NIAGARA-ON-THE-LAKE SITE
Discussion took place about an article in the newspaper regarding deceased animals dumped on a site on the south side of Townline Road.
Direction was given for staff to provide information regarding the mentioned dumping site.
