4. DISCUSSION / ANALYSIS Section 50, Subsection 5 (Part Lot Control) of the Planning Act, S.O. 1990, provides that where land is within a plan of subdivision, no person shall convey a part of any lot or block. The applicant is proposing to temporarily remove part lot control, the mechanism in place which controls the subdivision of land through Section 50, Subsection 7. This exemption from part lot control will eliminate the need for individual severance applications. Once the dwellings are constructed, the lots can be surveyed according to the line established between the common walls of the dwellings. The proposed by-law will expire after three (3) years. Submitted with the application is a reference plan of Block 35, the property that is the subject of the application; this is attached as Appendix A. These lots comply with Zoning By-law 4316-09, as amended to date. A draft by-law to release Block 35 on Plan 30M-404 from part lot control has been prepared for the Committee's consideration and is attached as Appendix B. 5. FINANCIAL IMPLICATIONS There are no cost or revenue implications for the Town arising from this application. 6. COMMUNICATIONS Once the by-law has Council’s approval, it can be registered on title.
7. CONCLUSION The approval of the release of part lot control by-law will facilitate the development of separately conveyable lots on Block 35, Plan 30M-404.
